This Disclaimer applies to all content, information, and services provided on the Bitnomi web portal (the "Portal"), mobile app, and any related communications (collectively, the "Content"). By accessing or using the Portal or our services as a Virtual Asset Service Provider ("VASP") operating in Sri Lanka, you acknowledge and agree to this Disclaimer. This disclaimer is in addition to our terms and conditions and privacy policy.

1. No financial advice

The content is provided for informational and educational purposes only and should not be construed as legal, tax, investment, financial, or other professional advice. Nothing on the Portal, including descriptions of virtual assets (Bitcoin, USDT), market data, guides on on/off ramps, Lightning Network usage, or planned features like remittances and payments, constitutes a solicitation, recommendation, endorsement, or offer by Bitnomi (the "Company") or any third party to buy, sell, hold, or trade virtual assets, securities, or financial instruments in Sri Lanka or any other jurisdiction.

All content is of a general nature and does not address your individual financial situation, risk tolerance, or objectives. It does not constitute professional financial advice, nor a comprehensive or exhaustive statement of the matters discussed, related laws (including those under the Financial Transactions Reporting Act, Prevention of Money Laundering Act, or Central Bank of Sri Lanka directives), or market conditions. The Company is not acting as a fiduciary, advisor, or broker through your use of the Portal, app, or Content.

You assume sole responsibility for evaluating the merits and risks associated with using any information or content before making any decisions. You agree not to hold the company, its affiliates, directors, officers, employees, agents, or third-party partners liable for any possible claim for damages arising from any decision you make based on the content or other information available on the portal.

  1. Investment risks and no guarantees

Virtual assets, such as Bitcoin and USDT, are highly volatile and speculative. Their value can fluctuate dramatically due to market conditions, regulatory changes, technological developments, or other factors. The Company does not guarantee any returns, profits, or protection against losses. Past performance of virtual assets is not indicative of future results.

As a non-custodial VASP, the Company facilitates transactions but does not hold or control your virtual assets, private keys, or seed phrases. You bear full responsibility for the security and management of your wallet and assets. The company is not liable for any losses due to market volatility, errors in transactions, or your failure to secure your assets.

  1. Impersonation scams and false investment schemes

The company warns users about the prevalence of scams in the virtual asset space, including impersonation fraud, where bad actors pretend to be affiliated with the company, its employees, or its owner to deceive you.

  • Impersonation Risks: Scammers may create fake websites, social media accounts, emails, or messages impersonating Bitnomi, its owner (Sajith Caldera), or staff. They may use similar logos, domain names (such as variations of Bitnomi.com), or contact details to trick you into sending virtual assets/sending LKR, sharing private keys/seed phrases, or providing personal information.

  • False Investment Schemes: Beware of unsolicited offers promising high returns, "guaranteed" profits, or exclusive investment opportunities claiming to be from the company. These may include fake airdrops, Ponzi schemes, rug pulls, or phishing links directing you to malicious sites. The company does not offer or endorse any investment schemes, staking rewards, or yield-generating products unless explicitly stated in our official Terms and Conditions.

  • How to Protect Yourself: Always verify communications through official channels only (our verified official email: sajith@bitnomi.com). The company will never ask for your private keys, seed phrases, or wallet recovery information. Do not click on suspicious links or transfer assets or money to unverified addresses/account numbers. Report any suspected impersonation to us at sajith@bitnomi.com and relevant authorities (Sri Lanka Police Cyber Crimes Division or FIU).

The company makes reasonable efforts to monitor and prevent such scams, but cannot guarantee their elimination. You are solely responsible for verifying the authenticity of any communication or offer. The Company shall not be liable for any losses resulting from impersonation scams, false investment schemes, or your engagement with fraudulent third parties, even if they impersonate the Company or its owner.

  1. General limitations and no liability

The content may contain inaccuracies, errors, or become outdated due to rapid changes in the virtual asset market or regulations. The company disclaims any warranties, express or implied, regarding the accuracy, completeness, or availability of the Content.

To the fullest extent permitted by Sri Lankan law, the Company is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the portal or content, including but not limited to losses from scams, investment decisions, or security breaches of your personal devices/wallets.
